Conditions Of Use and Sale
THESE CONDITIONS IN ADDITION TO THE TERMS OF TRANSPORTATION GOVERN YOUR USE OF THE MOBILE APPLICATION, THE SOFTWARE, AND THE WEBSITE, COLLECTIVELY KNOWN AS THE APPLICATION. IT IS IMPORTANT THAT YOU READ AND UNDERSTAND THE TERMS, AS YOU ARE AGREEING THAT THESE TERMS WILL APPLY IF YOU CHOOSE TO ACCESS, USE THE APPLICATION OR THE TRANSPORTATION SERVICE. IF YOU DISAGREE WITH THESE TERMS AND CONDITIONS OR ANY PART OF THESE CONDITIONS, YOU MUST NOT CONTINUE.

These terms and conditions were last updated on 9th of August 2016. Please check back regularly to see updated terms and conditions. We may amend these Terms and Conditions from time to time. Any amendment will be effective immediately. Your continued use of the application or transportation service after any amendment becomes effective, constitutes an agreement by you to abide by and be bound by these Conditions, as so amended. Images on the Application and the headings in these Conditions are for convenience and illustration purposes only and shall not affect your interpretation. Words in the singular reflect the plural.

Definitions
"We, Us, Our" means Londoncalltaxi.co.uk, the Agent who has been engaged by you at the time of reservation to facilitate the Transportation Service from the Principal herein referred to as the Transport Provider by using the application.
"You, Passenger" means the individual who makes a reservation or is the recipient of the Transportation Service from the Transport Provider;
"Reservation" means any order for the provision of Transportation Service that is facilitated by us, and confirmed by us in accordance with the provisions of the agreement herein.
"Transportation Service" means the provision of a driver and a vehicle to facilitate the service of ground transport including any instalment of the service or any multiple services in accordance with these Conditions.

Use of Services
2.1. The application is only available to individuals aged 18 years or older. By accepting this Agreement, you represent that you understand and agree to the foregoing;
2.2. You agree that the use of the Transportation Service will be subject to our Terms of Transportation, the Terms and Conditions that govern the use of the Transportation Service as accepted by you at the time of Reservation.
2.3. You agree to use the application only for purposes permitted by this Agreement, and only to the extent permitted by any applicable law, regulation, or generally accepted practice in the applicable jurisdiction.
2.4. Nothing in this Agreement shall be construed to convey to you any interest, title, or license in a User ID, domain name, or similar resource used by you in connection with the application.

Copyright
3.1. You agree that you will not reproduce, copy, duplicate, sell, resell, rent or trade the application (or any part thereof) for any purpose.
3.2. Londoncalltaxi.co.uk, the Londoncalltaxi.co.uk logo, and other Londoncalltaxi.co.uk trademarks, service marks, graphics, and logos used in connection with the application are trademarks or registered trademarks of Londoncalltaxi.co.uk, in the UK and/or other countries. You are granted no right or license in any of the aforesaid trademarks.
3.3. Londoncalltaxi.co.uk's Proprietary Rights. You acknowledge and agree that Londoncalltaxi.co.uk and/or its licensor's own all legal right, title and interest in and to the application, including any and all intellectual property rights that exist therein, whether registered or not. You further agree that the application contains proprietary and confidential information that is protected by applicable intellectual property and other laws, including but not limited to copyright. You agree that you will not use such proprietary information or materials in any way whatsoever except for use of the application in compliance with this Agreement.

Third Party
4.1. Links and Other Third Party Materials. You agree that we are not responsible for the availability of such sites or resources, and do not endorse or warrant the accuracy of any such sites or resources, and shall in no way be liable or responsible for any content, advertising, products or materials on or available from such sites or resources.

DISCLAIMER
5.1. WE SHALL USE REASONABLE SKILL AND DUE CARE IN PROVIDING THE APPLICATION. THE FOLLOWING DISCLAIMERS ARE SUBJECT TO THIS EXPRESS WARRANTY. WE DO NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF THE APPLICATION WILL BE UNINTERRUPTED OR ERROR-FREE. YOU EXPRESSLY UNDERSTAND AND AGREE THAT THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE AND OUR AFFILIATES, SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IN PARTICULAR, WE MAKE NO WARRANTY THAT (I) THE APPLICATION WILL MEET YOUR REQUIREMENTS; (II) YOUR USE OF THE APPLICATION WILL BE TIMELY, UNINTERRUPTED, SECURE OR ERROR-FREE; (III) ANY INFORMATION OBTAINED BY YOU AS A RESULT OF THE APPLICATION WILL BE ACCURATE OR RELIABLE; AND (IV) ANY DEFECTS OR ERRORS IN THE SOFTWARE PROVIDED TO YOU AS PART OF THE APPLICATION WILL BE CORRECTED.

INDEMNIFICATION
6.1. You agree to defend, indemnify and hold Londoncalltaxi.co.uk, its affiliates, subsidiaries, directors, officers, employees, agents, partners, contractors, and licensor's harmless from any claim or demand, including reasonable attorneys' fees, made by a third party, relating to or arising from a breach by you of any of the provisions of these terms and conditions.

Entire Agreement
7.1. This Agreement and the Terms of Transportation constitute the entire agreement between you and Us. They collectively govern your use of the application and completely replace any prior agreements between you and Londoncalltaxi.co.uk in relation to the use of the application or transportation service.
7.2. If any part of this Agreement is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.
7.3. The failure of Londoncalltaxi.co.uk to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. You agree that, except as otherwise expressly provided in this Agreement, there shall be no third-party beneficiaries to this agreement.

Jurisdiction
8.1. Your use of the application includes the ability to enter into agreements and/or to make transactions electronically. YOU ACKNOWLEDGE THAT YOUR ELECTRONIC SUBMISSIONS CONSTITUTE YOUR AGREEMENT AND INTENT TO BE BOUND BY AND TO PAY FOR SUCH AGREEMENTS AND TRANSACTIONS. YOUR AGREEMENT AND INTENT TO BE BOUND BY ELECTRONIC SUBMISSIONS APPLIES TO ALL RECORDS RELATING TO ALL TRANSACTIONS YOU ENTER INTO ON THIS APPLICATION, INCLUDING RESERVATIONS, NOTICES OF CANCELLATION, POLICIES, CONTRACTS.
8.2. Agreement shall be governed by the laws of England & Wales.
THESE "TERMS OF TRANSPORTATION", GOVERN YOUR USE OF THE TRANSPORTATION SERVICE. IT IS IMPORTANT THAT YOU READ AND UNDERSTAND THE FOLLOWING TERMS. YOU HAVE ACCEPTED THAT THESE TERMS WILL APPLY TO THE USE OF THE TRANSPORTATION SERVICE AT THE TIME OF YOUR RESERVATION. IN THE INSTANCE THAT YOU HAVE NOT MADE YOUR RESERVATION DIRECTLY BUT VIA A RESELLER, ADDITIONAL TERMS MAY APPLY OR REPLACE SOME OF THESES TERMS.

Definitions
"We, Us, Our" means Londoncalltaxi.co.uk, the Agent who has been engaged by you at the time of reservation to facilitate the service from the Principal herein referred to as the Transport Provider.
"You, Passenger" means the individual who makes a reservation or is the recipient of the Transportation Service from the Transport Provider;
"Transport Provider" means the Principal, an organisation or individual, taxi or private hire contractor, who are Entities authorised and licensed by Authorities to provide the said Transportation Service.
"Driver" means the driver and vehicle provided by the Transportation Provider who provides the Transportation Service.
"Reservation" means any order for the provision of Transportation Service that is confirmed by Us in accordance with the provisions of the agreement herein.
"Transportation Service" means the provision of a driver and a vehicle to facilitate the service of ground transport including any instalment of the service or any multiple services in accordance with these Conditions.

Reservations
1.1. Reservations submitted by you shall not be deemed to be accepted or confirmed by us, unless and until a Confirmation Order Number is provided by us.
1.2. The service will only be supplied as stated on the website or the mobile application. Reservations received other than these will be adjusted accordingly. Illustrations, photographs or descriptions whether on the website, brochures, price lists or other documents issued by us are intended as a guide only and the contents shall not be binding on us, or the Transport Provider.
1.3. The price for the Transportation Service quoted by us at the time of payment selection is final, any and all previous quotations will become invalid, null and void.
1.4. Both we and the Transport Provider schedule Transportation Service requests from airports in accordance with scheduled arrival times, every effort will be made to monitor flight arrival times only, departure times will not be monitored, and drivers will be dispatched accordingly. Londoncalltaxi.co.uk and the Transport Provider will endeavour to provide a timely service in accordance with the conditions of this agreement, but will not be held liable in any way for any delay in delivery of the Transportation Service.
1.5. Approximate journey times displayed on the website or application are to be used as a guidance only. We do not guarantee and will not be held liable for any delays on route, resulting in delayed collections.
1.6. In the event that Transport Service is delayed or any condition such as described in section 9 of this agreement occurs;- a) The passengers will be informed, and as such, clause 2.2 may be invoked by the passenger, and b) We will make all efforts to ensure that passengers are not stranded, and may at times have no other alternative than to offer the option of a replacement from a local licensed Transport Provider that may only provide Transportation Service on the basis of cash payment. If the pre-payment option has been selected at the time of reservation for the Transportation Service, and the passenger accepts this option. Then cash payment from the passenger would become due to the driver, and any pre-paid amount charged by Londoncalltaxi.co.uk would be refunded.
1.7. We reserve the right to make any changes in the specification of the services which are required to conform with any applicable safety or other statutory or regulatory requirements or, where the services are to be supplied to the Transport Providers specification, which do not materially affect performance.
1.8. No variation to these Conditions shall be binding unless agreed in writing between you and Londoncalltaxi.co.uk.
1.9. Any typographical, clerical or other accidental errors or omissions in any sales literature, quotation, price list, acceptance of offer, invoice or other document or information issued by us shall be subject to correction without any liability on our part.

Cancellations
2.1. Cancellations can be notified to us utilising your mobile application, calling our 24 hour customer support line, or via our website.
2.2. You have the right to cancel your reservation if the driver is beyond 15 minutes late of the agreed pick up time, if prepaid you will be refunded in full. This clause will be subject to clause 1.4.
2.3. Cancellation on arrival, cancellations that are not informed of, cancellations informed less than 5 hours before the reserved pick up time, or reservations that are deemed to be of the status "NO SHOW" are subject to a charge of 100% of the quoted fare, to clarify no refund will be due.
2.4. Cancellations informed 5 hours prior to the booked journey time are subject to a charge of £5.00 GBP and will be subject to clause 5.1.
2.5. It is your obligation to notify Londoncalltaxi.co.uk of the Cancellation of the Transport Service as a result of flight cancellations or diversion.
2.6. Londoncalltaxi.co.uk or the Transport Provider have the right to cancel the provision of service 60 minutes prior to the pick up time without liability, if pre-paid, any amount charged will be refunded in full.
2.7. Vehicles that are booked by you that are not suitable for the purpose for which they have been booked, due to excess luggage amounts as per clause 8.1, 8.1.1, and 8.1.2 will be subject to clause 2.3.

No Show
3.1. In the instance that you or the passengers are not at the correct or pre-agreed pick up location, or you or the passengers have not informed us of any such delay, a maximum of 15 minutes from the time of reserved pick up time it will be deemed to be a "NO SHOW", and will be subject to clause 2.3.

Feedback and Complaints
4.1. Complaints, regarding any service that is facilitated by Londoncalltaxi.co.uk can be lodged via our website, whereupon they will be investigated after which a conclusion will be provided within a maximum of 30 days from the date of the complaint. Where appropriate details of Transport Providers who provided Transportation Services will be provided upon any reasonable request and at our discretion.
4.2. By providing the feedback, you authorise us to publish the same on our website and other associated networking sites. Please note that the feedback may be edited due to the limitation of some sites.

Fees and Amendments
5.1 Any additional charges or refunds will be subject to an administration fee of £3.00 GBP.
5.2. Refunds are processed within a maximum of 10 working days and will be subject to clause 5.1.
5.3. If you amend a journey after confirmation, the new calculated cost will not be subject to any online discount or promotion or voucher coupon at the time of the original reservation, and will be calculated according to the prices in place on the day of the request for amendment, and will be subject to clause 5.1.
5.4. All passenger collections, apart from collections from airports, waiting time is free for the first 5 minutes; thereafter waiting time will be calculated at the rate of £0.35 GBP per minute on the entire waiting time. Airport collections: 30 minutes free waiting time from the time of landing in addition to free waiting time requested by you at the time of reservation, thereafter charges are applicable at the rate of £0.35 GBP per minute and will be subject to clause 5.1.
5.5. Any additional charges for waiting time or changes in the specification of a journey after confirmation will be due immediately and may be charged automatically by Londoncalltaxi.co.uk, and will be subject to clause 5.1.
5.6. Toll charges incurred by the Transport Provider, excluding the London Congestion Charge Zone, whilst passengers are on board will become due from the passengers to the driver in the form of cash payment for the total cost of the toll charge.

Child Seats
6.1. The current UK law governing the use of child seats in private hire vehicles and taxis states that;
6.1.1. Children under 3 years of age can travel without a child car seat or seat belt, but only on the back seat.
6.1.2. Children aged 3 years or older can travel without a child car seat if they wear an adult seat belt.
6.2 Child seats can be requested whilst making a reservation. They are divided into 3 categories; infant seat 0-12 months of age, child seat 1-4 years of age and booster seats 4 years and above. Due to the dynamic and fluid nature of scheduling Transportation Services instances may occur where non-availability of requested child seats materialise. Passengers would be informed prior to the pick up time and the fare would be adjusted accordingly.

Passenger Obligations
7.1. Any damage caused to vehicles by you or the passengers will be charged according to actual repair amounts, in addition you will also be liable for a daily vehicle off road charge of £100.00 GBP per day.
7.2. Any reservation on which you or a passenger of your party soils a vehicle, it will be subject to an additional minimum charge of £60.00 (GBP), if such amount becomes due then clause 5.1. will also be applicable.
7.3. Londoncalltaxi.co.uk and the Transport Provider have the right to refuse the Transportation Service without any liability to you or the passenger if it is deemed that you or any of the passengers are under the influence of drugs, alcohol or are being abusive, clause 2.3. will become applicable.

Luggage, Limitations and Allowances
8.1. Luggage sizes are not standard, as such the Service will use the formula as listed in clauses 8.1.1 and 8.1.2 to determine vehicle sizes, luggage that does not fall into this criteria will be deemed to be additional items and as such may incur additional charges.
8.1.1 The combined dimensions of 1 piece of check in luggage (Width+Depth+Height) may not exceed 158 cm.
8.1.2. The combined dimensions of 1 piece of hand luggage (Width+Depth+Height) may not exceed 115 cm.
8.2. Neither, Londoncalltaxi.co.uk nor the Transport Provider will accept responsibility for loss or damage to luggage. You are responsible for ensuring that your luggage is loaded/unloaded at all times, if accompanying the luggage on the journey. Londoncalltaxi.co.uk and or the Transport Provider have the right to refuse any passenger or to provide Transportation Service due to the passenger having excess luggage which would result in the vehicle being unsafe whilst in motion. Furthermore In the instance where unaccompanied luggage is transported. You agree to defend, indemnify and hold Londoncalltaxi.co.uk and the Transport Provider harmless from all claims, demands, causes of actions, damages, liabilities, costs and expenses, including attorney fees, arising from or related to your acts or omissions in connection with your use of the Service.
8.3. In the instance where unaccompanied luggage is transported. If the Transport Provider is unable to obtain a signature for the receipt of luggage, on such delivery, the Transport Provider is within his remit to return the luggage to our storage facility, and will be subject to additional delivery costs. Furthermore any item of lost luggage, or undelivered luggage will be stored for a maximum of 90 days after which Londoncalltaxi.co.uk will dispose of any such items as it sees fit without any liability to you or the passenger. For the avoidance of doubt, the Transport Provider will not carry in its vehicles any of the following: Explosives, firearms, flammables, tear gas, mace, pepper spray Perishables, Fragile, breakable, or temperature sensitive items, Pets (unless secured in an official transportation approved container), insects, animals (other than registered Guide Dogs for the visually impaired), Cash, Hazardous waste, Pressurised containers, Securities and negotiable papers, Human remains, Alcoholic beverages, or anything containing alcohol, Illegal narcotics/drugs.
8.4. Direct Wheelchair accessible vehicles may not be available, and as such it is the duty of you to ensure that information relating to your specific requirement is provided to the Londoncalltaxi.co.uk utilising available methods on the mobile application, software or website.
8.5. Children under 16 years of age are not permitted to travel in vehicles by themselves. It is your obligation to ensure that this clause is followed.

Force Majeure
9.1. Londoncalltaxi.co.uk or the Transport Provider shall not be liable to you or be deemed to be in breach of this agreement by reason of any delay in delivery or in performing, or any failure to perform, any of the obligations in relation to the Service, if the delay or failure was due to any cause beyond our or Transport Providers reasonable control. Without prejudice to the generality of the foregoing, the following shall be regarded as causes beyond reasonable control directly or indirectly:-
9.1.1. act of God, adverse weather, explosion, flood, tempest, fire or accident;
9.1.2. war or threat of war, sabotage, insurrection, act of terrorism, civil disturbance or requisition;
9.1.3. acts, restrictions, regulations, bye laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority;
9.1.4. traffic accidents, traffic hold ups, traffic congestion or road closures;
9.1.5. strikes, lockouts or other industrial actions or trade disputes (whether involving employees of the Transport Provider or of a third party);
9.1.6. flight delays, flight cancellations, early flight arrivals;
9.1.7. power failure or breakdown in machinery including vehicles and computer systems.
9.2. Subject as expressly provided in these Conditions, all warranties, conditions or other terms implied by statute or common law are excluded to the fullest extent permitted by law.
9.3. Except as expressly provided in these Conditions, Londoncalltaxi.co.uk shall not be liable to you by reason of any representation, or any implied warranty, condition or other term, or any duty at common law or under statute, for any direct or consequential loss or damage sustained by you (including, without limitation, loss of profit or indirect or special loss), costs, expenses or other claims for consequential compensation whatsoever (and whether caused by the negligence of Londoncalltaxi.co.uk the Transport Provider, its servants, or otherwise) which arise out of or in connection with the facilitation of the services.
9.4. If you are in breach of any of the clauses listed in this agreement then without prejudice to any other right or remedy available to Londoncalltaxi.co.uk, Londoncalltaxi.co.uk shall be entitled to cancel the contract or suspend any further deliveries under the contract without any liability to you, and if the Services have been delivered but not paid for the price shall become immediately due and payable notwithstanding any previous agreement or arrangement to the contrary.

Entire Agreement
10.1. This Agreement constitutes the entire agreement between you and Londoncalltaxi.co.uk and governs your use of the Transportation Services and completely replaces any prior agreements between you and Londoncalltaxi.co.uk in relation to the Transportation Services.
10.2. If any part of this Agreement is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.
10.3. The failure of Londoncalltaxi.co.uk to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. You agree that, except as otherwise expressly provided in this Agreement, there shall be no third-party beneficiaries to this agreement.
10.4. This Agreement shall be governed by the laws of England & Wales.
Privacy Policy (last updated in May 2018)

We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998). We collect information about you for 2 reasons: firstly, to process your reservation and second, to provide you with the best possible service.
We will give you the chance to refuse any marketing email from us in the future. The type of information we will collect about you includes your name, address, phone number, email address, geo location data, and your credit/debit card details to ensure that we are able to provide the best possible service. We will never collect sensitive information about you without your explicit consent. In the interest of safety and security, vehicles providing the transportation service may be fitted with cctv.
The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly. If we intend to transfer your information outside the EEA (European Economic Area) we will always obtain your consent first.

We have set out to describe in this Privacy Policy how we collect, use, process, and disclose your data, in addition to your access and use of our Website and services. It also sets out to inform you how you can exercise Your Rights concerning data. Londoncalltaxi.co.uk in respecting the current laws regarding the protection and security of the data of its users and customers when visiting and/or using our Website (as a "User") or (as a "Customer"), recognises the importance of protecting privacy and rights with regards to data protection.

Who Controls Personal Data

When this policy mentions "Londoncalltaxi.co.uk", "we," "us," "our" or "Data Controller", it refers to: Londoncalltaxi.co.uk responsible for the processing of Users' and/or Customers' personal data under this Privacy Policy.

When you visit our Website (as a "User") or then purchase our services (as a "Customer"). Personal data, where requested, is necessary for the adequate performance of the contract between you and us and to allow us to comply with our legal obligations. Without it, we may not be able to provide you with all the requested services. It is important that all the personal data you provide when you register as a User or otherwise when you use our Website is correct and accurate. This includes, by way of example only, ensuring that we have your correct contact email details at all times. If you plan to submit someone else's personal data to us, for instance when booking on their behalf, you should only provide us with that third party's details with their consent and after they have been given access to this Privacy Policy.

Data collected automatically from our Website and from third parties. Information about your visits to and use of our Website, such as information about the device and browser you are using, your IP address or domain names of the computers connected to our Websites, uniform resource identifiers for requests made, the time of request, the method used to submit the request to the server, the size of the archive obtained as a response, the numerical code indicating the status of the response given by the server (correct, error, etc.) and other parameters relative to the operating system and the computer environment used, the date and time that you visited, the duration of your visit, the referral source and website navigation paths of your visit and your interactions on our Website including the Services and offers you are interested in. To the extent permitted by the applicable law wherein we receive additional information about you, such as fraud detection information and warnings from third party service providers and/or partners for our fraud prevention activities.
